Welcome to Daily Forex Signals website (the “Site”). The site is managed and operated by FX Alpha Trade Ltd. (the “Company”). The use of this site, including the material included and services granted by it, constitutes your agreement to these terms and therefore your are requested to read them carefully. Certain of the services are subject to your explicit approval and to the terms and conditions specified below and without your explicit approval you will not be able to use such services.
The term “Company” in these terms of use include also the Site, services granted in the Site, workers and employees of the Site, shareholders and office holders of the Company and/or the Site.
The Information contained in this site, including but not limited to forex signals, technical analysis, Forex forecast and other information, does not constitute advise or its substitution and/or a recommendation to purchase one or more of the products contained in the Site, such as: advertizes, service providers, information and content writers, companies or private or business entities, statistic and analyses data providers related to the Forex market. Any person and/or entity relaying on the information contained in this Site, in any manner, acts as such on its own account and hereby relives the Company from any responsibility and/or liability. Nothing contained in the Site constitutes an offer or advice to take any action. The Company shall not be liable to any damage caused due to any mistakes in drafting and/or wording etc. The Company shall not be liable to any damage caused to the clients or any third party due to the content and/or reliability and/or use of the information contained in the Site and/or information sent by the Site and/or any action taken directly or indirectly.
The Company has the right, at its sole discretion and without prior notice to change, from time to time, these terms of use, the Site's structure and content and such change will apply as of the date of its publication in the Site.
Links
The Company may provide links to other worldwide web sites or resources in the Internet. The publication of other internet sites in the Site does not constitute an agreement of the Company to the content in such links and does not constitute a guarantee to their being reliable, up to date, legal, conform to standard privacy provisions and/or any aspect of their operation and use. The Company does not warrant that the links referred to in the Site are operative and that they will lead you to an active internet site. The Company has the right, at its sole discretion and without prior notice, to remove existing links or to add new links.
Commercial Contents
The Site contains commercial information, such as advertisements and announcements that are published by various users and ad providers, who offer to sell their goods and services. Such content may be by text, audio or photos. The company shell not be held liable and/or responsible for the commercial contents published in the Site. The sole responsibility to commercial contents and to any cost or expense related to the use or otherwise relaying upon said contents shall be on the owners of such content. Publication of commercial contents in the Site shell not be held as a recommendation or as an inducement to purchase goods, services or products offered for sale in the commercial contents, and the company shell not be held liable in respect to the purchase of any such goods and services advertized in the commercial contents.
Service Modifications
You acknowledge and agree that the Company reserves the right, in its sole discretion and at any time, to modify, change, add to, terminate, or discontinue, collect fees, with respect to an individual user or all users, the services and/or any associated services, information and content, or technical specifications with or without notice to you, and that the Company will not be responsible or liable, directly or indirectly, to you or any other person in any way for any loss or damage of any kind incurred as a result of, or in connection with, any such modification or discontinuance. You hereby agree and acknowledge that the company shall not be liable in respect of any failure by you to receive signals on your phone, as much as such is by no fault of the Company.
Proprietary Rights
All trademarks and intellectual property contained in the Site, its material content, in its services offered and/or any content included or embodied in it are the sole property of the Company, or of other third parties which have granted the Company a right of use and therefore it is prohibited to copy, distribute, publicly display, transfer to the public, change or modify anything related to the Site and its content, by yourself or with a third party, in any manner or way, electronic, mechanical, optic, photo or audio devices or any other manner, without obtaining the prior written approval of the Company and under the terms of such approval by the Company, if granted. You undertake not to transfer to any person or entity the Signals (as such term is defined below) which you will receive by phone from the Company in any manner, directly or indirectly, including through the phone or other forums through the internet and/or any other method. If you will publish or transfer any Signal received to any person and/or entity, then the Company shall be entitled to claim from you damages which have or will be caused to it for such publication of the above Signal.
Publication on the Site
The Company reserves the right at its sole discretion to suspend and/or cancel and/or refuse to publish any content, including commercial contents if it is in the opinion that such content breaches these terms or that the execution of any deed and/or any action causes or will cause damage to the services provided in the Site, or its users or for any other reason as the Company shall deem fit. The Company has the right, at its sole discretion to edit, change or shorten any materials approved by it for publication.
Signals and Prices
The Company allows you to register to the foreign currencies trading signaling short message service (SMS) (the “Services” and “Signals” respectively). Receiving the Signals is subject to pre-registration to the Site and to all terms of this agreement. The cost of the Signals service is (a) for German users: 0.5 Euro for each SMS, (b) for England users: 0.5 Pound Sterling for each SMS, and (c) for the rest of the world: first 30 days free and thereafter a monthly fixed fee to be paid by credit card in the amount of 24.90 US$ for all SMS signals received during such month. All payments (except those paid by credit card) shall be collected at the beginning of each month in respect to services granted during the previous month. All payments paid with a credit card shall be collected in the beginning of each month in respect to such month. The Company shall be entitled to change the price of payment for receipt of Signals and/or Services which shall enter into force in the beginning of the following month to such publication. The Service shall be granted by the Company as of the date of registration and until its termination by the Company or the Client by providing a 5 days prior written notice. In the event that for any reason a payment and/or payment method shall not be complied with, then in such event the Company shall be entitled to terminate the grant of the Service without derogating from any of its rights. A receipt shall be sent to the Client to the address specified upon registration by the Client. In order to remove any doubt, it is hereby clarified that by registration of a Client to the Services, the Client agrees that the Services shall be provided on a monthly basis without limitation and without providing notice to such effect and without regard to the use or unused of the Services. It shall be the user’s sole responsibility to provide notice of termination of automatic continuance of the Services, whereby termination of the Services shall apply at the end of the month in which notice of cancelation was submitted.
Policy for Refund of Money
Policy for refunding money paid for goods and services which the company provides or sells directly; especially signal services or telephonic or audio trading room, discs, courses, commercial workshops for which the company is fully responsible. A registered customer who has paid for one of the company services or products, and cancels before receiving the services or products, will receive the money paid in full.
Method of Payment
The company collects payment by any accepted method used in internet trading including cash payment, credit cards, cheques, and money transfers. All products and services may be obtained from the company in three interest free installments. Interest charges and commission charges determined by credit card companies are not the responsibility of the company.
Online purchasing via the website
The company enables its customers to purchase its goods and services online by means of an automatic direct debiting system. The system is highly secured; the customer details and methods of purchase are erased automatically from the system. The customer may also purchase any product by telephone.
Risk Warning
The Client hereby warrants and represents that he is aware that Forex trading is dangerous and fluctuates and that any person and/or entity which is active in this field, is required and advised to act cautiously with all and any protections available before taking any action in respect to the Forex market and to carefully evaluate its financial situation and his compatibility to such type of trading. The user hereby undertakes that any action to be performed by him in the Forex market through the Service or based on information published in this site, including but not limited to technical analysis and Forex forecast, shall be on its own account and after due discretion and on its sole account and liability. There is great importance to financial and mental strength of a trader. Trading in financial tools whilst using high investment leverage is speculative trading with special high risk level. The risk of loss money due to investment trading or speculative currency or any other financial asset is significant. Whereas Forex trading could amount to a significant financial loss to the trader, it is hereby advised to execute such investments using capital which is not required for current living or with critical importantly to the trader and the Company shall not be liable for any loss of investment of the user caused by the type of trading and great risk involved in such trading. The user hereby warrants that it is clear to him and that he agrees that in any event a competent court will impose liability on the company, then the compensation to be paid by the Company to the user for loss of investment, or other losses, shall not exceed the total amounts paid by the user to the Company as service fees.

The information disclosed and appearing on the site, including but not limited to estimates, Forex forecasts and technical analysis, are not necessarily updated and/or accurate, and the company shall not be liable for their exact validity. The company shall not be liable to the customer, user, or any third party who acts according to any information appearing on the site, for any reason including inaccuracy , or delay in updating of information details, such as quotations, news, and graphs based upon quotations, or any other data. The user declares that signals which he receives in the framework of the service do not guarantee any earnings and they reflect subjective opinions of the service providers only, on the basis of technical analysis methods. The customer also declares that he is fully aware that the company is not obliged to send a minimum number of signals, and that the sole judgment as to whether to send signals and the shares or stocks which will be analyzed, according to which the service is provided, is the Company’s alone, as are all the factors and decisions taken for operating the service in practice, and the customer will have no claims and/or demand of any kind in connection with this matter. The customer undertakes that he will not claim or demand in any way, from the company, anything connected to the signals, and that he will not have any claim or demand against the company in connection to the service, including claims in respect to damages and /or losses, direct and/or indirect, and/or indemnity claims and the user hereby waives all claims in these matters.
Special Clarifications
The audio trading room and/or any other service and/or information (such as technical analysis and/or Forex forecast, which is offered or provided by the company, is an integral part of the company activity, and as such is bound to all the instructions and warnings which are cited herein. All operations and/or acts on account of the audio trading room and/or Signals for the purpose of investment are made on the sole responsibility of the user.
It is herein clarified that the company, its directors , workers, shareholders, and their designates, which operate at the site, are not licensed consultants and/or portfolio managers, according to the USA Law, and the service is not defined as “investment advice" within the meaning of the law " and they do not aspire to advise any person in connection with the value or worth or profitability of any purchase, selling, holding, investing in mutual funds, foreign currency, financial instruments, and the service and /or information that appears on the site does not constitute advise of any kind, or recommendation of any kind, related to the profitability, and/or holding and/or purchasing, and /or sale of mutual funds, financial instruments and/or carrying out such or any other operations, and they are the sole subjective information related to different signals which are received according to technical analysis methods from third parties with whom the company is in contact with. Accordingly, the information which is disclosed in the service, including the site, the audio trading room, signaling service, announcements and data and any other material published on the site, from any recommendation or opinion and any decision made, based on any information appearing on the site, is made on such entities sole responsibility.
The user declares that he is aware that nothing on the site, is a substitute for examining, testing, and consulting in relation to the needs and special requirements of the user or any other person, and that the investment in financial assets may cause losses and even heavy losses.
The company, its managers, workers and designates who operate the site, may have personal interests in any matter arising and/or contained in the Site, and may hold currencies, financial instruments of any kind mentioned on the site.
Advertisements
It is clarified herein that the users agreement may be cancelled by means of sending a message of cancellation to the company in writing or by the same means with which the advertisements were sent.
As long as the customer has not cancelled his agreement to receive advertisements, the company will be authorized, according to the Law, to use customer details and/or, pass on his details to a third party in order to expose the registered users to update and/or commercial material which may be relevant in connection with them, including email, SMS, or other channels, and material that the company and/or a third party chooses to pass to the user. A user who is not interested in this may cancel this option at the time of registration as a registered user.
Privacy
The company is authorized to collect information concerned with use and patterns of use, and use this for improving the services that the company offers, for the purposes of focused advertising or for other commercial purposes.
It is clarified herein that in any circumstance in which the company is requested by an official authority which operates from within its legal mandate, to pass on evidence and/or information which is within its possession, including IP addresses, that is in the possession of the company, then the company will act pursuant to the provisions of the applicable law and will pass on the required information.
